Terms of Service

These Terms govern your use of the daita website, AI agents and related services (the “Service”), provided by daita, München, Germany. By using the Service you agree to these Terms. If you use the Service on behalf of an organisation, you accept on its behalf.
1. The Service
daita provides AI agents that answer, qualify and book across chat, voice and connected channels, plus the tools to configure and embed them. Features, plans and limits are described on our website and may evolve.
2. Accounts & eligibility
You must provide accurate information and keep your access credentials secure. You are responsible for activity under your workspace. You must be legally able to enter a contract and use the Service only for lawful purposes.
3. Acceptable use
- Don’t use the Service to break the law, infringe rights, or send unlawful, harmful or deceptive content.
- Don’t attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service or other customers’ data.
- Don’t misrepresent the AI as a human where disclosure is required; keep the AI disclosure enabled where we provide it.
4. Plans, billing & trials
Paid plans are billed in advance for the stated period. For our Shopify app, charges are processed through the Shopify Billing API under your Shopify account. Free trials convert to the paid plan unless cancelled before they end. Usage beyond a plan’s allowance may be metered as described at purchase. Taxes may apply.
5. Your data & privacy
You retain ownership of your content. We act as your processor and never use your data to train third-party models. How we handle data is described in our Privacy Notice and Trust Center; a Data Processing Agreement is available on request.
6. Intellectual property
The Service, software and brand are owned by daita and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. You keep your content and trademarks.
7. Third-party services
The Service integrates third-party providers (e.g. cloud, model and channel providers) listed in our Trust Center. Their terms may also apply to those components.
8. Disclaimers & liability
The Service is provided “as is”. AI output can be inaccurate and must not be relied upon as professional advice; verify consequential actions. To the extent permitted by law, daita is not liable for indirect or consequential damages, and our aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing limits liability that cannot be limited by law.
9. Term & termination
You may stop using the Service or cancel a subscription at any time (effective at the end of the paid period). We may suspend or terminate access for breach of these Terms or to comply with law. On termination, data is handled per our retention and deletion practices.
10. Changes
We may update these Terms; we will revise the “last updated” date and, for material changes affecting paying customers, give reasonable notice. Continued use means acceptance.
11. Governing law
These Terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is München, to the extent permitted by law.
